1. Agreement to terms

These Terms & Conditions ("Terms") govern access to and use of GyanSpark — the SDK, the customer portal, and this website — provided by Preative Solutions Private Limited ("Preative Solutions," "we," "us," or "our"). By creating an account or using GyanSpark, you agree to these Terms. If you're accepting on behalf of an organization, you're confirming you have authority to bind that organization.

2. What GyanSpark is

GyanSpark is a developer SDK and customer portal that education platforms integrate into their own products to add AI-powered personalization for their students. We provide the infrastructure; our customers are responsible for their own products, their relationships with their end users, and compliance with laws applicable to how they use GyanSpark.

3. Eligibility & accounts

• You must be able to form a legally binding contract to create an account — either as an individual adult or as an authorized representative of an organization.
• You're responsible for keeping your account credentials secure and for all activity under your account.
• You must provide accurate account information and keep it up to date.
• You're responsible for notifying us promptly if you believe your account or API keys have been compromised.

4. Acceptable use

You agree not to:

• Use GyanSpark to violate any applicable law, or the rights of any third party, including your own end users' privacy rights.
• Attempt to reverse-engineer, disrupt, or gain unauthorized access to GyanSpark's systems.
• Share, sell, or sublicense API keys or account access outside your own organization.
• Use the service to build a directly competing product using data obtained through it.
• Submit end-user data you don't have the legal right or consent to send us.

5. Fees & billing

Paid plans are billed on the cycle and terms shown at signup or in your portal account. Prices are subject to change with advance notice to active customers.

6. Intellectual property

Preative Solutions retains all rights, title, and interest in GyanSpark — the SDK, portal, underlying models, and infrastructure. These Terms grant you a limited, non-exclusive, non-transferable right to use GyanSpark as intended; they don't transfer any ownership to you. You retain ownership of your own content and the data your systems submit to us.

7. Third-party services

The customer portal supports signing in via Google. Using that option means you're also subject to Google's own terms and privacy policy for that interaction — we only receive the profile information Google shares with us for authentication.

8. Disclaimers

GyanSpark is provided "as is" and "as available." We don't warrant that the service will be uninterrupted, error-free, or that any specific learning outcome will result from its use. To the fullest extent permitted by law, we disclaim all implied warranties, including merchantability, fitness for a particular purpose, and non-infringement.

9. Limitation of liability

To the fullest extent permitted by law, Preative Solutions will not be liable for any indirect, incidental, special, or consequential damages arising from your use of GyanSpark. [ ] A specific liability cap (e.g. tied to fees paid in the prior 12 months) needs to be set here with legal input.

10. Termination

You may stop using GyanSpark and close your account at any time. We may suspend or terminate accounts that violate these Terms, pose a security risk, or for non-payment, with notice where reasonably possible. On termination, your right to use the service ends; provisions that by their nature should survive (ownership, disclaimers, liability limits) will continue to apply.

11. Changes to these terms

We may update these Terms as the product evolves. We'll update the "Last updated" date above, and make a reasonable effort to notify active customers of material changes. Continued use after changes take effect means you accept the updated Terms.

12. Governing law
